When the workers experience the death of someone close to them then the Bereavement Leave give them time to step away from their work which leads to term of losing worrying about the impact on their income. These leave are available to full-time and part-time workers who have been employed for six months or more. These leave can be taken after experiencing the loss of an immediate family member.

The employee can take Bereavement Leave during the time of losing their immediate family which includes spouse, partner, sibling, child, grandparent, partner’s parent, or other close ones. The Federal New Zealand Government has passed this bill which has introduced the three-day paid leave for intent of death, miscarriage or newborn child. This bill also applies to the parents having a child through adoption.

What is Bereavement Leave?

The Bereavement Leave are the federal paid leave given to an employee time to grieve and to take care of matters. These are the federal benefits which can be taken at any time for the purpose relating to the bereavement. Along with these, the employers are often to give some additional leave above the minimum entitlement which depends on the individual circumstances. These leave allow the eligible employees to entitle the three full days paid leave for each time, and one day leave for those who are outside their immediate family.

The eligible employees are offered their leave and holidays for alternative holidays, sick leave, public holidays, minimum leave and holidays entitlements, annual holidays, and other working days. But under the Bereavement Leave these are offered for parental leave, family violence leave, and other types of leave which are calculated other than holidays and leave. Before taking these leaves the employees are requested for proof which is prohibited either for good faith. Along with this both the employer and employees had to be responsive and communicate with each other.

Who is Entitled to it?

All employees including permanent, casual, fixed term, or part-time, are entitled to Bereavement Leave. But with this, they are also required to come under the below-mentioned criteria that include:

  • Worker have worked for their employer for at least 6 months or more.
  • The work has been done with an average of 10 hours per week.
  • Required to do the work for at least 40 hours in a month.

Along with these, the employees are entitled to leave every 12 months as long as they meet the entitled criteria. However, workers can even re-qualify for the leave after six months. The employees need to tell their employer before taking their leave.

These three-day Bereavement paid leaves entitle the employee’s immediate family members including their parent, child, spouses, and more. The employee has a miscarriage or a new birth.

All We Know

Unlike the annual leave and sick leave the Bereavement Leave is also based on the employee’s ordinary hours of work. These leaves don’t accrue they’re paid out on termination these leaves can be accessed with simply pay at a relevant daily rate.

The payment for Bereavement Leave is only made if the employees are working on the day. The payment has to be relevant to daily pay. If the employee has worked on a public holiday but has a bereavement, then that day would be counted as a paid public holiday. The employer needs to have a clear Bereavement Leave policy that is managed to support the workers.
